Important limitations on wellness content, AI insights, nutrition estimates and smart-device data.

Wellness only — not medical care. The Services do not provide medical advice, diagnosis, treatment, monitoring or emergency response. Consult an appropriately qualified healthcare professional when necessary and contact local emergency services in an emergency.

1. Purpose and scope

This Wellness and Medical Disclaimer applies to the websites, applications, memberships, smart devices, AI-assisted features, content, communities, partner benefits and related services offered by Bay Technologies Limited under Xinera by FoodTrack, Xinera and FoodTrack (collectively, the “Services”). It forms part of the Terms of Service.

The Services are intended to support general wellness, healthy lifestyle awareness and education. Unless a particular product is expressly identified in product-specific materials as a regulated medical device in your jurisdiction, the Services are not medical devices or medical services and are not intended for medical use.

2. Not medical advice or healthcare

Nothing in the Services is medical advice, diagnosis, treatment, monitoring, screening, prognosis, prescription or a substitute for professional healthcare. Bay Technologies is not acting as your doctor, dietitian, nutritionist, psychologist, physiotherapist, traditional Chinese medicine practitioner or other healthcare professional merely because you use the Services.

Use of the Services does not create a doctor–patient, therapist–client, dietitian–client or other healthcare-professional relationship. No employee, AI system, community member, coach, partner or content contributor can create such a relationship through the Services unless a separate, clearly identified professional service agreement expressly says so.

3. Consult a qualified healthcare professional

Always consult an appropriately qualified healthcare professional for questions about a symptom, diagnosis, medical condition, medication, supplement, allergy, pregnancy, diet, exercise programme or treatment. Never ignore, avoid or delay professional advice because of something presented by the Services.

Seek professional guidance before materially changing diet, fasting, exercise, sleep practices, supplements or weight-management activity, particularly if you:

  • have a diagnosed or suspected medical condition;
  • take prescription or over-the-counter medication;
  • are pregnant, trying to conceive or breastfeeding;
  • are under 18 or an older adult with frailty or fall risk;
  • have a history of an eating disorder, disordered eating, fainting or exercise intolerance;
  • have food allergies, intolerances or specialised dietary needs; or
  • are recovering from surgery, injury or acute illness.

Do not start, stop or change medication, medical treatment or clinician-prescribed nutrition based on the Services.

4. Emergencies and urgent symptoms

The Services are not an emergency-response system. We do not continuously monitor your data, and alerts, notifications or absent alerts must not be relied on to identify an emergency. We cannot dispatch assistance or contact emergency services on your behalf.

If you believe you may have a medical emergency—or experience symptoms such as severe chest pain, difficulty breathing, fainting, signs of stroke, a severe allergic reaction, uncontrolled bleeding, or thoughts of self-harm—stop using the Services and immediately contact local emergency services or go to the nearest emergency department.

5. AI-assisted insights and personalisation

Some outputs may be generated or assisted by artificial intelligence, statistical models or rules-based systems. These systems infer patterns from limited inputs and may produce inaccurate, incomplete, inconsistent, outdated or inappropriate results. Personalisation does not mean the system knows your full health status or has clinically assessed you.

A confident or precise-sounding output may still be wrong. You should consider the source, context and uncertainty; compare important information with reliable sources; and consult a professional where a decision could affect health or safety. Do not use AI-assisted output as the sole basis for diagnosis, treatment, medication, urgent action or a decision to avoid care.

6. Food, calorie and nutrition information

Food-image recognition, portion estimation and nutrient calculations are estimates. They can be affected by image quality, hidden ingredients, preparation method, serving size, recipe variation, restaurant information and database limitations. Calories, macronutrients, sugar, sodium, cholesterol, purines and other values may differ materially from the food actually consumed.

Do not rely on the Services to identify allergens, contaminants, alcohol, medication interactions or ingredients that must be avoided for a medical, religious or safety reason. Check packaging, recipes and the food provider directly. If you have an allergy or medically prescribed diet, follow professional advice and verified ingredient information.

Recommendations are not a guarantee of weight loss, muscle gain, metabolic improvement or any other result. Individual outcomes vary and may be affected by health conditions, medication, behaviour, environment and measurement error.

7. Tongue, face and traditional wellness insights

Any tongue-image, face-image, constitution or traditional-wellness analysis is provided for general wellness awareness and education. It is not a physical examination, laboratory test or diagnosis. It must not be used to identify or rule out disease, nutritional deficiency, infection or any medical condition.

Traditional Chinese wellness concepts and Western nutrition concepts may use different frameworks, and the nature and strength of scientific support may vary by claim. The Services do not represent that a traditional concept has been clinically validated merely because it is displayed alongside modern wellness information. Consult a qualified professional for interpretation relevant to your circumstances.

8. Smart-device and wearable measurements

Consumer smart rings, scales and connected devices may estimate steps, activity, sleep, heart rate, heart-rate variability, stress, blood oxygen, temperature trends, body composition or related metrics. Readings can be affected by fit, placement, motion, skin contact, circulation, skin characteristics, tattoos, environmental conditions, battery level, software, algorithms and individual physiology.

Unless expressly stated in an approved product label for your jurisdiction, measurements are not clinical-grade and are not intended to replace a medical device, laboratory test, polysomnography, electrocardiogram, pulse oximeter or professional assessment. A normal reading does not rule out a medical problem, and an unusual reading does not establish one.

Do not use a device reading to adjust medication, oxygen, insulin or other treatment; to decide whether emergency care is needed; or to monitor a condition for which a clinician has prescribed medical equipment. If a reading is unexpected, repeat it under appropriate conditions and consult a healthcare professional when necessary.

9. Exercise, recovery and physical risk

Physical activity carries risks including falls, musculoskeletal injury, overexertion and cardiovascular events. Recommendations cannot account for every condition, injury, medication or environmental factor. Choose activity appropriate to your current ability, use safe technique and surroundings, and stop if you experience pain, dizziness, faintness, unusual shortness of breath, palpitations or other concerning symptoms.

Readiness, strain, recovery or stress scores are estimates and do not establish that an activity is safe. If a healthcare professional has restricted your activity, follow that professional’s instructions.

10. Skin contact, charging and device safety

Follow all device instructions, warnings, water-resistance limits, cleaning guidance and charging requirements. Keep devices and small components away from children where they may present a choking or ingestion hazard. Stop wearing or using a device if it causes significant irritation, swelling, pain, overheating or other adverse effects.

Do not use or charge a visibly damaged, swollen, leaking or unusually hot device. Move away from flammable materials if safe to do so and contact customer support for handling instructions. Seek medical care for a burn, persistent skin reaction or other injury.

11. Community and third-party content

Community posts, testimonials, partner content and external links reflect the views of their authors or providers and may be inaccurate or unsuitable. We do not endorse a medical claim merely by displaying or linking to it. Do not treat another user’s experience as evidence that the same approach is safe or effective for you.

Where a third party offers a class, spa treatment, meal, supplement, product or professional service, review its qualifications, ingredients, contraindications, terms and regulatory status. Consult a healthcare professional where appropriate. Bay Technologies is not responsible for an independent provider’s clinical judgment or service except where applicable law makes us responsible.

12. No clinician monitoring or medical record

Submitting data does not mean a clinician has reviewed it. Unless an expressly identified service states otherwise, no one is monitoring your information for deterioration, adverse events or emergencies. Do not assume that silence, a missing alert or continued app access means you are well.

Information in the Services may not constitute a complete medical record and should not replace records held by healthcare providers. If you choose to share a report with a professional, tell the professional how the data was generated and that it may contain estimates or errors.

13. Product-specific regulated claims

If a device or software feature is expressly and lawfully marketed as a regulated medical device in a particular jurisdiction, follow its approved labelling, instructions for use, intended purpose, warnings and contraindications. Those product-specific materials control if they conflict with this general Disclaimer. A regulatory status in one country does not automatically apply in another.

14. Research, content and changing evidence

Wellness and nutrition information evolves. Content may summarise research but is not a systematic review of all evidence, and publication does not guarantee that information is current, complete or accepted by every professional body. We may update content and algorithms as evidence, products and standards change.

15. Results and testimonials

Testimonials, examples, challenges, rankings and before-and-after stories are illustrative and do not guarantee typical or future results. Wellness outcomes vary. You remain responsible for deciding whether and how to act, obtaining professional advice, and using the Services safely.

16. Liability and mandatory rights

To the fullest extent permitted by law, Bay Technologies does not warrant the medical accuracy, completeness or suitability of the Services for your circumstances and is not liable for decisions made in unreasonable reliance on wellness information or estimated measurements. The disclaimers and liability limits in the Terms of Service also apply.

Nothing in this Disclaimer excludes or limits liability for death or personal injury caused by negligence, fraud, wilful misconduct, a defective product where liability cannot be excluded, or any consumer or other right that applicable law does not permit us to waive.
